What you can expect from us when you send a flower, and what we ask of you.
Who we are
Say It In Bloom (sayitinbloom.com) is the trading name of Farid Amiri, a sole trader, of 4th Floor, Silverstream House, 45 Fitzroy Street, Fitzrovia, London W1T 6EB, United Kingdom. You can write to us at support@sayitinbloom.com. To tell us about a gift that troubled you, use Report a gift.
These terms apply when you send a gift. Our privacy notice explains what we do with the information you give us.
What you are buying
A gift: a flower that grows and opens on the receiver’s screen, with your letter, your voice if you choose to record it, a piece of music and their name played as it opens, delivered by email on the day you choose or by a link you pass on. Each costs £5, $6 or €6, with any VAT or sales tax included. Everything a gift can be is in that price. There is no subscription, and no account.
It is digital content, made and delivered online. Nothing is posted, and no real flowers are sent.
Who can send
You must be 18 or over to send a gift, and you must be the person paying for it. Anyone can receive one.
Paying
Payment is taken on Stripe’s checkout. The gift is sold to you through Link, Stripe’s service that acts as the merchant of record: Link takes the payment, works out and pays any VAT or sales tax, and sends your receipt, and your statement will show LINK.COM*. For questions about a charge, Link’s support can help (support.link.com). We never see your card details.
The price may be shown in your own currency at checkout. You pay once, when you send.
Before it is sent
Before any gift is sent, an automated system reads the letter and the words of any recording, to keep out what the rules below forbid. Most gifts pass in seconds. If it is unsure, a person reads it, and we tell you it is being looked at. We may decline to send a gift that breaks these rules; if we do, we refund it in full.
A gift sent by email arrives on the day and at the time you choose, in their time zone. A gift sent by link is yours to pass on, and opens from its day if you chose one. Recordings are cleaned and levelled so they sound close and clear; your words are never changed.
Changing your mind
Until a gift reaches them, you can move it to another day or cancel it from its own page (the link is in the email we send when you pay), and we refund it in full. A gift has reached them when its email has been sent or, for a gift sent by link, when it is first opened.
Because a gift is made as soon as you pay, you ask us, by paying, to begin at once, and you accept that once it has reached them it can no longer be cancelled. This does not affect your legal rights: if a gift does not work as we describe, tell us and we will put it right or refund you. Link may also refund a payment where its own rules allow.
You can delete a gift, its words and its recordings at any time, before or after it reaches them.
Your words and your voice
What you write and record stays yours. You allow us to keep it, to clean and transcribe recordings, to check it as above, and to show and play it to the person you send it to, for as long as the gift is kept. Only record your own voice; do not include other people’s without their permission.
You are responsible for what you send. Make sure the receiver would want to hear from you.
What you may not send
Please don’t use Say It In Bloom to send anything that:
- harasses, threatens, bullies or frightens someone, or reaches a person who has asked not to hear from you;
- is sexual, or sexualises anyone, and never anything involving a child;
- encourages self-harm or suicide, or celebrates violence;
- attacks people for who they are, such as their race, religion, sex, sexuality, disability or nationality;
- pretends to come from someone else, or deceives the receiver;
- advertises, sells, collects money or personal details, or is sent in bulk;
- is unlawful, or infringes someone else’s rights.
We may switch off a gift that breaks these rules, and refuse further gifts from whoever sent it.
Receiving a gift
Anyone with a gift’s link can open it, so it should be shared with care. Its receiver can reply in their own voice, for up to thirty seconds, and the reply goes to the sender. If a gift or a reply troubles you, use the report link on its page: we switch it off while a person looks at it.
How long a gift is kept
A gift is kept for 2 years from its day, then its words and recordings are deleted. Its sender can delete it sooner. A receiver can keep a pressed plate or a film of it on their own device.
Plates and films
A plate or a film made from a gift is the receiver’s to keep and share with people they know. The flower’s drawing, the music and the design of the page remain ours and our licensors’, so please don’t sell them or use them to advertise.
Our responsibility
We take care to make every gift as described and to keep the site running, though we cannot promise it will never be interrupted. If we break these terms or fail to use reasonable care, we are responsible for loss you suffer that was a foreseeable result. We are not responsible for loss that was not foreseeable.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Otherwise, for any gift our responsibility is limited to the price you paid for it.
Changes, and the law
We may update these terms. The terms in force on the day you paid apply to that gift.
These terms are governed by the law of England and Wales. If you live elsewhere in the United Kingdom or in the European Union, you keep the protection of your own country’s consumer law and may bring a claim in its courts.
